EULA - (End User License Agreement)

IMPORTANT-READ THIS ENTIRE DOCUMENT CAREFULLY: This document is an End-User License Agreement ("EULA"). It is a legal agreement between the individual end-user ("you") and "RageKings.com" (Ragekings LLC). Everyone who uses "RageKings.com/'s CMS Software" and/or is a "RK-End-User," is required to read and agree to the following EULA. This agreement has been made available to you pre-purchase, therefore we reserve the right to not provide you with a refund. If you don't agree with this EULA you cannot use this software Period. To have accessed this agreement prompt, you have already obtained access to some of our files. As a failsafe, before any individual's payment is accepted, they are required to have viewed this EULA, and by sending any payment, they realize that they will need to agree to be legally bound by this EULA to use the products and services provided by "RageKings.com". If you have obtained any part of our software, and you do not agree to this EULA, you need to remove all traces of our files and software immediately. This EULA pertains to all software, intellectual property, media, printed materials, documentation, accounts (both "Client" and "Forum"), forum information, tutorials, technical support, or other information and/or files, which have been obtained from " "RageKings.com" either directly, indirectly, through any online connection or transfer, by any offline means, or physically transferred. Not agreeing with this EULA will result in immediate account termination, without warning, without refund (see "Payments and Refunds Section " for more information), as it was made available to you pre-purchase, and you were made aware that agreement to it is a requirement to use our products and/or services. PAYMENTS AND REFUNDS Any funds sent to RageKings.com are to gain access to the community by attaining supporter access to the forums, any information found within RageKings.com is free to all supporters and should not be used for any illegal activities. Any funds sent which are counterfeit will not only be terminated, but also be punished to the full extent of the law. Any failure to comply with this EULA will forfeit any funds paid to "RageKings.com" for any services at anytime. This includes pre-paid services. There will be NO REFUNDS offered to anyone at anytime for any reason. All services provided by this group are physically completed immediately, or they are provided in a manner in which the service is completed immediately when any payment is sent and received. Therefore there are no refunds offered to anyone at anytime for any reason, as the services paid for have already been received. Anyone who attempts to chargeback funds from this group will be applicable to any pursuit deemed necessary, which includes but is not limited to legal proceedings. All money to be sent to "ragekingsales@gmail.com" and should only be sent after (1) first notifying a "member of Management" that you are requesting to send in funds (2) getting a reply which will contain a verification from a "member of Management" that it is acceptable to send funds, as well as the place to send the funds to. Any funds sent to the wrong address or person is not the responsibility of "RageKings.com." We reserve the right to keep any funds to "RageKings.com" if the correct procedures are not followed. We reserve the right to deny any and all payments from any End-User at anytime, without reason, effectively ending their "Subscription." RageKings.com SOFTWARE LICENSE AGREEMENT The terms of this Software License Agreement (this "Agreement") shall apply to all versions, editions, and future updates of RageKings.com C.M.S. software and constitute a legal agreement between you (the "Licensee") and RageKings.com (the "Licensor"). BY DOWNLOADING, INSTALLING OR USING CMS SOFTWARE, THE LICENSEE IS CONSENTING TO BE BOUND BY AND IS BECOMING A PARTY TO THIS AGREEMENT. IF LICENSEE DOES NOT AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, ACCEPTANCE MUST NOT BE SPECIFIED BELOW AND LICENSEE MUST NOT INSTALL OR USE THE SOFTWARE. RageKings.com RESERVES ALL RIGHTS NOT SPECIFICALLY GRANTED HEREIN. Licensor grants Licensee a non-exclusive and non-transferable license to use CMS software only for non-commercial entertainment purposes. Licensee may not disassemble, decompile, reverse engineer, redistribute (in any form), create derivative works of, or modify CMS software in any way. Licensor reserves the right to terminate the license at any time and for any reason, or no reason at all, and without notice to licensee. Licensee will forfeit all funds paid to Licensor and will NOT receive any kind of refund. Additionally, upon breach of any term of this Agreement, the license granted under this Agreement shall automatically terminate without any additional notice to Licensee. Upon termination of the license, Licensee shall destroy all copies of CMS software in Licensee’s possession. Licensee also acknowledges and agrees that CMS software is self-updating, which means that future updates will, from time to time and without any notice, automatically be downloaded and installed as a normal and expected function of CMS software. Licensee further acknowledges and accepts that CMS software may be considered invasive. Licensee understands that CMS software inspects and reports information about the computer on which it is installed to other connected computers and Licensee agrees to allow CMS software to inspect and report such information about the computer on which Licensee installs CMS software. Licensee understands and agrees that the information that may be inspected and reported by CMS software includes, but is not limited to, (Internet Protocol) hardware devices and other variables on the hard-drive and in the memory of the computer on which CMS software is installed. Further, Licensee consents to allow CMS software to transfer actual PC Hardware Information of Licensee’s computer during the operation of CMS software. Licensee understands that the purpose and goal of RageKings.com is to ensure a leaker/anti cheat-free environment for all of RageKings.com members. Information gathered about Licensee is to verify accounts and identity is secured while you maintain your agreement of this EULA. We reserve the right to post whatever information we feel the need to, wherever we feel we need to, when a violation of this EULA occurs. This includes but is not limited to reasoning which may prevent such violations to occur with the end-user in the future, whether inside of "RageKings.com" or any other group. Licensee agrees that the invasive nature of RageKings.com CMS software is necessary to meet this purpose and goal. RageKings.com CMS SOFTWARE IS PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTY OF ANY KIND INCLUDING, BUT NOT LIMITED TO, AND WITHOUT LIMITATION, THAT IT IS FREE OF DEFECTS, FIT FOR A PARTICULAR PURPOSE, OR THAT IT IS MERCHANTABLE. LICENSOR DOES NOT WARRANT THAT THE OPERATION OF RageKings.com CMS SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT IT WILL MEET LICENSEE'S SPECIFIC REQUIREMENTS OR DESIRES. LICENSEE AGREES THAT NEITHER. RageKings.com, ITS ADMINS, DIRECTORS, STAFF, CODERS, BETA TESTERS, OWNERS, BUSINESS PARTNERS, SUCCESSORS NOR ASSIGNS SHALL BE LIABLE FOR ANY CLAIM WHATSOEVER INVOLVING RageKings.com CMS SOFTWARE IN ANY WAY. FURTHERMORE, SHOULD ANY VERSION OF RageKings.com CMS SOFTWARE, INCLUDING FUTURE VERSIONS, PROVE DEFECTIVE IN ANY WAY, LICENSEE ASSUMES THE ENTIRE COST, IF ANY, OF LOSS OR DAMAGE OF ANY TYPE AND TO ANY DEGREE. THIS WARRANTY DISCLAIMER SHALL SURVIVE TERMINATION OF THE LICENSE OF RageKings.com CMS SOFTWARE BY LICENSEE, REGARDLESS OF WHETHER THE LICENSE IS TERMINATED BY RageKings.com OR LICENSEE. This Agreement constitutes the entire agreement between Licensor and Licensee and supersedes any prior statements, whether written or oral. DEFINITIONS: This section defines terms used in this document (above and below this point) to provide clarity. RageKings.com/: refers to an online based entity which can be found at www.RageKings.com. RageKings.com Staff: refers to a user group of RageKings.com who are elevated above the normal end-user, either as technical support or administrative personnel. Administrator: refers to a person with direct access to the end-user account database. End-User: refers to 1 person who has obtained a valid account from a RageKings.com Staff member, also referred to as "V.I.P Supporter" C.M.S. Client: refers to “Content Management Softwareâ€Â� a piece of software used to verify account status and transfer our files to the member from a database or "Server" where they are held. Also referred to as "CMS" or "RageKings.com CMS Software" Funds: Refers to any and all form of Currency (USD), money, etc. Also referred to as "Money," "Payment," We  reserve the right to make changes without notice and are not responsible for typographical errors Thank you for your support
